LEARNING OBJECTIVES
The course is basically divided in two parts. In the first part, the course deals with the fundamental models of legal orders of the World. The second part deals with the different forms of State and government. Some legal systems are considered in particular (UK, USA, France, Germany).
COURSE CONTENTS
Topic and methods of Comparative Public Law. Common law and equity in England. The legal order of the USA. Others common law legal orders. Constitution and constitutionalism. The model of the civil law. French and German models of civil law. The reception of the civil law model. Switzerland, Austria, Belgium, The Netherlands. The Nordic Countries, the Iberian Peninsula, the Latin-American legal systems. The East-Europe. Bohemia, Moravia, Slovenia, Poland, Baltic Countries, Hungary (Croatia, Slovakia, Transylvania). Russia, Ukraine, Walachia, Moldavia, the South Slavic Region. The so called Islamic Law. The legal system of India. The Chinese legal system. The Japan legal system. Forms of State. Federal and Regional State. Forms of government (parliamentary, presidential, semi-presidential and Swiss systems). The models of judicial review of legislation. The judiciary power. Judicial Review of Legislation. Some legal systems are considered in particular (UK, USA, France, Germany).
