LEARNING OBJECTIVES Roman Law and fundamental of European law purpose is about achieving the main themes concerning the study of the historical European process in private Roman law.The most important features are: 1) The Genesis and the evolution concerning the principal institutions of private Roman law.2) The Codes relative to the Late Antiquity. 3) Private Roman law tradition and its adaptation to the European juridical states during the Middle-ages and the Modern age which are strictly connected with both canonic law and iura propria. 4) Law acknowledgement in the Universities. 5) The role of the Medieval legal science. 6) Legal Humanism. 7) The actual guidelines concerning the elaboration of an European ius commune.
COURSE CONTENTS A. 1) Elements of general law theory connected with Roman law legal experience. 2) Private Roman law chronological analysis. 3) Subjects, objects and legal relations. 4) The civil process. 5) Juridical negotiation acts concerning the ius privatum. 6) Succession laws after death. 7) Ius privatum and its absolute relations. 8) Ius privatum relative relations. B. 1) Pluralism and legal system. 2) Ius commune set up. 3) Revival of legal science and Roman law. 4) Humanist studies contribution. 5) Roman law reception. 6) European ius commune.
