LEARNING OBJECTIVES The course deals with the study of constitutional law through the examination of individual articles of the Republican Constitution, based on contributions from doctrine and case law available on the subject. The objective of the course is twofold; In the first place, to provide the student with the in-depth knowledge of the various elements that make up the Italian constitutional law, without forgetting the links with the national and the European ones; Secondly, it is intended to provide the student with the necessary skills to find out the links that the other legal subjects that are required for analysis in the course of law studies have the constitutional right.
COURSE CONTENTS The class follows the structure of the Italian Constitution, divided in four main parts: 1) in the first part , it explains the basic elements of constitutional law, both in general terms and as related to the Italian legal order. This part pays particular attention to the sources of law and their mutual relationships; 2) in the second part, we illustrate the so-called form of State and form of Government, namely the state structure, the characteristics of the different constitutional bodies and their mutual interrelationships; 3) a third part focuses on the different categories of personal freedoms guaranteed by the Republican Constitution, as well as on the structure of the regional and local autonomic bodies; 4) the class ends with a wide examination of the characteristics and prerogatives of the Italian Constitutional Court, as well as a study of the impact that these prerogatives have on other constitutional bodies and on the general constitutional order.
