FORMATIVE OBJECTIVES The teaching of navigation law aims to provide students with an overall and dynamic view of the phenomenon of navigation in its complexity and the articulated reality of transport. The course aims to analyze the main institutions of navigation law and the reality of transport, in the light of national, EU and international legislation, providing students with an organic view of the subject and the cognitive tools functional to the solution of practical cases and the development of a autonomous critical and evaluation skills
COURSE CONTENTS The program of the course concerns the analysis of the main institutes of navigation and transport law within the general framework and its national, community and international sources. During the lessons the historical and evolutionary characteristics of the subject will be examined; current national, EU and international regulatory sources; issues related to the organization and exercise of navigation; the legal figures present in the world of navigation. All the private aspects of the matter will also be explored: the contracts for the use of the ship and aircraft; the discipline of the liability of the operator and the carrier; transport documents. Particular attention will be paid to the complex reality of transport. In particular the topics covered are: - The Right of Navigation: general profiles - Navigation assets and services - The operation of the ship and the aircraft - Ship and aircraft use contracts - Transport - Liability for damage resulting from navigation
